Hello. We are NEONCAT. We provide podcast hosting, distribution, and related tools for creators, and advertising products for advertisers. Use of the NEONCAT platform—including hosting your podcast with us—indicates that you have read and agreed to these Terms of Service, our Privacy Policy, and any other policies we link here (together, the "Terms"). Description of service

NEONCAT distributes audio content via platforms such as Apple Podcasts, Spotify, Google Podcasts, and other directories. We provide hosting, an RSS feed, a creator dashboard, analytics, and optional monetization tools. For advertisers, we offer access to our creator network and inventory. Eligibility and accounts

To host and distribute content you must open an account. You can create an account by choosing a plan at neoncat.fm, completing purchase (including via guest checkout), and setting your password when we send you the link. If you are an individual, you must be at least 18 years old to open an account. If you are opening an account on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

You must ensure that all information you provide is true, accurate, current, and complete, and you must update your account if details change. You must keep your password confidential. You are responsible for any activity on your account. If you set up access for other users (e.g. contributors), they must also comply with these Terms, and you are responsible for their use of the platform. You agree to reimburse us for any losses (including reasonable legal fees) that result from your or your users' breach of these Terms or misuse of the service.

Your content and conduct

You are solely responsible for the content you post and the consequences of posting it. You promise that: you have all rights necessary to grant us the permissions we need; your content does not infringe any third party's intellectual property or other rights; your content complies with applicable laws and our content policies; and you will not post illegal, abusive, defamatory, or infringing material, or use automated means to generate false traffic or artificial content. We may remove content that violates these Terms or our policies and may suspend or terminate your account without refund if we believe you have breached or will breach the Terms.

Ownership and license

You retain ownership of your content and intellectual property. By posting content on NEONCAT, you grant us a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, distribute, and make your content available (including via RSS and embeds) as needed to operate the service and to promote NEONCAT. This licence allows us to distribute your content to listeners and to third-party platforms. We are not obliged to promote your content but we provide tools to help you do so. You are responsible for backing up your content; we are not responsible for loss of or damage to your content.

Payment and billing

Subscriptions are described on our website and are sold subject to those descriptions. We process payments via Stripe. You must be at least 18 and have a valid payment method to subscribe. Subscription periods are monthly or annual and renew automatically unless you cancel. We may offer a free trial; eligibility is at our discretion. If we change prices, we will give you notice and the change will apply after your current period unless we state otherwise. If we have incorrectly priced a plan, we may charge the correct amount or cancel the order and notify you. Refunds are as stated on our website (e.g. cancellation during a free trial or within the first month may entitle you to a refund; otherwise fees paid are generally non-refundable). You may cancel via your dashboard or by contacting us.

Termination

We may change, suspend, or discontinue the platform or your access if you breach these Terms or if we reasonably believe you will breach them. We may delete your account and data after prolonged inactivity. You may close your account at any time (subject to any outstanding payments). If you close your account, your subscription will end at the end of the current billing period; we may retain content and data as described in our Privacy Policy or as required by law.

Disclaimers

The service is provided "as is". To the fullest extent permitted by law, we disclaim all warranties, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure, or that defects will be corrected.

Limitation of liability

Except where prohibited by law, we are not liable for indirect, incidental, special, or consequential damages (including loss of profit, data, or goodwill). Our total liability to you for claims arising from your use of the service or these Terms will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or a nominal amount if you have not paid. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold NEONCAT and its affiliates, officers, and agents harmless from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of the platform, your content, or your breach of these Terms.

Governing law and disputes

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer law in your country requires otherwise.

Changes to terms

We may change these Terms at any time. We will notify you by posting revised Terms on the platform and/or by email to the address you provided. Unless we say otherwise, changes take effect a reasonable time after notice (e.g. 3 days). Your continued use of the platform after that constitutes acceptance. We may also change features or pricing; significant reductions in functionality may entitle you to cancel and, where applicable, to a refund as described on our website.

Payment records are retained as required by law. You may request deletion of your data; we will comply subject to legal and operational requirements (e.g. backup, dispute resolution).
